These Terms & Conditions apply to consumers only (individuals purchasing wholly or mainly for personal use).
1. DEFINITIONS
1.1 "Seller", "we", "us" or "our" means The Home Shutter Company Limited.
1.2 "Buyer", "you" or "your" means the consumer placing an order.
1.3 These Terms apply to all bespoke shutter products and installation services supplied by us and may only be varied in writing by us.
2. QUOTATIONS & CONTRACT FORMATION
2.1 All quotations are invitations to treat and do not constitute a legal offer.
2.2 Your order constitutes an offer to purchase. A legally binding contract is formed only when we issue written order acceptance and receive the agreed deposit.
2.3 All quotations are estimates only and may be withdrawn or amended prior to acceptance. Prices include delivery and installation unless stated otherwise.
3. BESPOKE PRODUCTS
3.1 All shutters supplied by us are bespoke and made-to-measure.
3.2 Due to the bespoke nature of the products, specifications are final once the order is accepted, subject to your statutory rights and clause 10 below.
4. DELIVERY & INSTALLATION
4.1 Delivery and installation dates are estimates only and time shall not be of the essence.
4.2 Typical lead times are:
Wooden shutters: in excess of 95 days
EU- Manufactured UPVC shutters: in excess of 30 days
4.3 Lead times are estimates only due to international shipping and manufacturing variables and cannot be guaranteed.
4.4 Delays caused by events outside our reasonable control (including shipping delays, supplier issues, or force majeure events) shall not entitle you to a discount or compensation, but we will install your shutters as soon as reasonably possible.
4.5 Risk remains with us until installation is completed.
4.6 This clause does not affect your statutory rights.
5. PAYMENT TERMS
5.1 A deposit of 50% of the total order value is required before production begins.
5.2 The remaining balance is payable on the day of installation.
5.3 If payment is not made when due, we may charge statutory interest in accordance with applicable consumer legislation.
6. MEASUREMENTS & SITE CONDITIONS
6.1 We will take final measurements prior to manufacture.
6.2 You must ensure no alterations are made to windows or surrounding areas after final measurements have been taken, including but not limited to plastering, handles, window boards, tiles, alarms, or trims.
6.3 We accept no responsibility for misfit or defects caused by alterations made after measurement.
7. INSTALLATION STANDARDS
7.1 Installation methods will be determined on site by our installers, prioritising structural integrity and uniform appearance.
7.2 Shutters may be fixed to masonry, plasterboard, window frames, or tiled surfaces as appropriate.
7.3 If you are not present at survey or installation, shutters will be installed in accordance with our standard practices unless otherwise agreed in writing.
8. PRODUCT TOLERANCES & APPEARANCE
8.1 Natural materials may display minor variations in colour, grain, and finish.
8.2 Minor imperfections not clearly visible at a distance of four feet under normal domestic lighting shall not be considered defects.
8.3 Dimensional tolerances of ±5mm per panel are acceptable.
8.4 Panel warp shall not exceed 1.5mm per 300mm.
8.5 Panels exceeding recommended size limits may require mid-rails or slat groupings to maintain warranty validity.
9. LIGHT CONTROL
9.1 Shutters are not blackout products.
9.2 Integrated blackout blinds typically achieve 85–95% light reduction but do not provide total blackout.
10. CANCELLATION RIGHTS
10.1 Your order is for bespoke, made-to-measure goods and is exempt from the standard 14-day cancellation period under the Consumer Contracts Regulations 2013.
10.2 Notwithstanding clause 10.1, we offer a voluntary 2-calendar-day cancellation period starting from the date your order is placed.
10.3 Cancellation must be communicated by email or telephone for traceability.
10.4 After this period, cancellation or modification is not possible and the full contract price remains payable, subject to your statutory rights.
11. DEFECTS, REMEDIES & ACCESS
11.1 You must notify us of any visible defects or concerns as soon as reasonably possible.
11.2 You must allow us reasonable access to inspect, photograph, and remedy any issues.
11.3 Repairs will be carried out using our own installers unless otherwise agreed in writing.
11.4 We are not liable for costs incurred by third parties without our prior written approval.
12. LIABILITY
12.1 We are responsible for providing goods that are of satisfactory quality, fit for purpose, and installed with reasonable care and skill.
12.2 We do not exclude or limit liability for death or personal injury caused by our negligence, or for any matter which cannot legally be excluded under the Consumer Rights Act 2015.
12.3 Subject to clause 12.2, our total liability shall not exceed the value of the contract.
13. WARRANTY
13.1 Our products are supplied with a 15-year warranty, subject to normal use and compliance with our specification guidelines.
13.2 Full warranty terms are available separately and form part of this contract.
14. OUR RIGHT TO MAKE CHANGES
14.1 We may make minor technical changes required by law or to improve product performance, provided such changes do not materially affect use.
14.2 If significant changes are required, you may cancel and receive a full refund for any product not supplied.
15. TERMINATION BY US
15.1 We may terminate the contract if you fail to pay, provide required information, or allow access within a reasonable time.
15.2 Where manufacture has commenced, payments already made will not be refundable due to the bespoke nature of the products.
16. DATA PROTECTION & RECORDINGS
16.1 Calls may be recorded for training and quality purposes.
16.2 We may take installation photographs for quality control.
16.3 All personal data is processed in accordance with UK GDPR and our Privacy Policy.
17. GOVERNING LAW
17.1 These Terms are governed by the laws of England & Wales and subject to the exclusive jurisdiction of the English courts.
Nothing in these Terms affects your statutory consumer rights.
